Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Firstag.io website and managed server-side Google Tag Manager infrastructure service (collectively, the "Service") provided by Firstag.io ("we", "our", or "us").

By accessing the Service or submitting an inquiry, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Firstag.io provides a fully managed hosting environment for Google Tag Manager server-side containers. The Service includes:

  • Provisioning and management of cloud infrastructure for your GTM server container
  • A custom subdomain or domain configuration
  • 99.9% uptime SLA (measured monthly, excluding scheduled maintenance)
  • Infrastructure monitoring, security patching, and incident response
  • Onboarding support and email-based technical assistance

The Service does not include Google Tag Manager licences, tag authoring, or marketing strategy consulting unless separately agreed in writing.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract. If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

4. Account and Access

Access to your server-side container is provisioned after successful onboarding. You are responsible for maintaining the confidentiality of any credentials we provide and for all activity that occurs under your account. Notify us immediately at hello@firstag.io if you suspect unauthorised access.

5. Fees and Payment

Subscription fees are charged monthly in Indian Rupees (INR) as stated on our Pricing page. Fees are billed at the start of each billing cycle and are non-refundable except as required by applicable law.

We reserve the right to change pricing with 30 days' written notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

Failure to pay fees within 10 days of the due date may result in suspension of the Service. Accounts suspended for non-payment for more than 30 days may be terminated.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Transmit malware, spam, or any harmful content
  • Scrape, mine, or otherwise collect personal data without proper consent mechanisms
  • Infringe the intellectual property rights of any third party
  • Engage in any activity that disrupts or degrades the Service for other customers
  • Resell or sublicense the Service without our prior written consent

We reserve the right to suspend or terminate access immediately if we reasonably believe a violation has occurred.

7. Data Ownership

You retain full ownership of all data, tags, and configurations within your GTM container. We do not claim any rights to your data. You grant us a limited licence to process your data solely for the purpose of delivering the Service.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your end users.

8. Uptime and SLA

We target 99.9% monthly uptime for your container endpoint. In the event of downtime attributable to us (excluding scheduled maintenance, force majeure, and issues caused by third-party providers), we will provide service credits upon request as follows:

  • 99.0%–99.9% uptime: 10% credit of monthly fee
  • 95.0%–99.0% uptime: 25% credit of monthly fee
  • Below 95.0% uptime: 50% credit of monthly fee

Credits are the sole and exclusive remedy for service outages and do not entitle you to a cash refund.

9. Intellectual Property

All intellectual property in the Firstag.io website, brand, and proprietary tooling remains exclusively ours. Nothing in these Terms grants you a licence to use our trademarks, logos, or proprietary software other than as necessary to use the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Termination

Either party may terminate the Service subscription at any time with 30 days' written notice. We may terminate immediately for material breach of these Terms. Upon termination, we will make your GTM container configuration available for export for 14 days, after which all data will be deleted.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered customers at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance.
